This contract is between the photographer and the client as detailed below,

The Photographer’s name: Lee Hawley

Address: Overton, Teddington, Glos, Gl20 8JA

1. Entire agreement

This agreement constitutes the entire agreement between the parties and supersedes all previous agreements (written or oral) between the parties in relation to its subject-matter.

Each party acknowledges that in entering into this agreement it has not relied on, and shall have no right or remedy in respect of, any statement, representation, assurance or warranty (whether made negligently or innocently) other than as expressly set out in this agreement.

Nothing in this clause shall limit or exclude any liability for fraud.

2. A Summary of the Contract
   Lee Hawley Photography is responsible for providing for the client a photographic service and products as detailed in section 3 (‘coverage’). The client undertakes to engage the Lee Hawley Photography for this coverage for the price as detailed in section 4. In the event of cancellation of the wedding, the full fee is owed.
3. The Coverage

Coverage will be provided by the Lee Hawley Photography as per the package specification detailed on your client web page. Time limits are as detailed, or when quoted as “full day” this is limited up to 9hrs. A small amount of additional time will be allowed at the photographers discretion. However when significantly more time is required, additional time is charged at £195 per additional hour. If the client required photography time of more than 9hrs it is the responsibility of the client to make Lee Hawley Photography aware of this prior to the day, so a fully transparent arrangement can be made.

Parking at all photography locations is required for one car. When parking is required at a seperate ceremony location to the bridal prep location, a reserved parking space is required for one car to ensure photography can reliably commence upon arrival.

4. Payment Arrangements

The client will pay Lee Hawley Photography the total fee agreed in your invoice subject to the following terms:

Any additional payments for albums and other services are to be made when that order is placed. Prices for orders placed over one year after the date of the wedding may be subject to change. This included orders included in the initial wedding package.

5. Copyright

The entire copyright in the photographs is retained by Lee Hawley Photography at all times throughout the world.

Where a disc or USB of photographs (digital image files) has been provided to the bride and groom as part of their wedding collection, these photographs may be printed, and displayed online, for personal but not commercial use.

All suppiers, contractors, venue or other proffesional contributor to your wedding, may only use the images on social media provided the post includes within the body of the post @lee_hawley_photography_ for instagram and @leehawleyphotography for facebook. They may not use the images for printed material or website without additional express concent from Le Hawley Photography.

Lee Hawley Photography retains the right in all cases to use the photographs in any manner at any time and in any part of the world for the purposes of advertising or otherwise promoting his work or any other use.

6. Image Size, Colour, Style and Composition

All image sizes are approximate. Lee Hawley Photography will provide a pleasing colour balance but cannot guarantee exact colour matching. It is sometimes not possible to record the exact colour as seen by the human eye.

Lee Hawley Photography provides a natural images. Lee Hawley Photographys style and philosophy is to capture real moments with minimal direction or staging.

There is no right to reject on the basis of style or composition. Although best efforts are made to, Lee Hawley Photography cannot guarantee the supply of any particular photographs that are requested.

Every effort is made to photograph all key moments, and all guests, however Lee Hawley Photography cannot guarantee that this will be 100% achievable due to practical and time limitations on the day. Any specific photographs of specific individuals need to be detailed to Lee Hawley Photography in writing prior to the wedding. Lee Hawley Photography will need assistance on the day identifying these individuals.

Under Legitimate Interest laws all guests and their children in attendance are giving permission to be photographed and potentially be included in photographs used by Lee Hawley Photography for promotional material or in social media posts. Lee Hawley Photography is to be notified in writing and the individuals identified on the day if anyone who does not wish to have images with them used in this way.

7. Archival Release

Once all products within the wedding package stated in section 3 have been delivered, Lee Hawley Photography is under no obligation to retain the digital image files. You online gallery will be live for a minimum of 6 months, afterwhich it may be deleted.

8. Attendance

Hours of coverage include any travel time between venues. In the unlikely event that Lee Hawley Photography is unable to complete the coverage due to unforeseen circumstances, Lee Hawley Photography reserves the right to appoint another photographer to attend on his behalf to undertake the photography.

9. Indemnity

Lee Hawley Photography agrees to indemnify the client against all expenses, damages, claims and legal costs arising out of any failure by Lee Hawley Photography to obtain any clearances for which he was responsible in respect of third party copyright works, trademarks, designs or other intellectual property.

The photographer shall only be responsible for obtaining such clearances if this has been expressly agreed before the day of the wedding. In all other cases the client shall be responsible for obtaining such clearances and will indemnify Lee Hawley Photography against all expenses, damages, claims and legal costs arising out of any failure to obtain such clearances.

10. Limitation of liability

In the unlikely event of a total photographic failure or cancellation of this contract by either party or in any other circumstances, the liability of one party to the other shall be limited to the total value of the contract. Neither party shall be liable for indirect or consequential loss.

11. Severability

If any provision of this contract is held unenforceable, then such provision will be modified to reflect the parties’ intention. All remaining provisions of this contract shall remain in full force and effect.

12. Jurisdiction

This shall be governed by and construed in accordance with English law, and each party agrees to submit to the exclusive jurisdiction of the courts of England and Wales.

The undersigned have read and understood the above contract and agree to the terms and conditions in their entirety.

13. GDPR

During the fulfilment of this contract I will need to keep personal data of yours. This will be done in compliance with GDPR laws May 25^th 2018. This data is your Names, email address and possibly your home address. I keep this for ongoing communications we may be having, Christmas cards and as an address to send completed photo packs to, or if we have future meetings planned or required. It is all stored on a secured hard drive with no paper copies, and it is not shared with 3^rd parties.

13. Albums

Where an album is included in your photography package, you will have your first draft sent to you for review within 3 months of the wedding, you then have a maximum of 18 month to make Lee Hawley Photography aware of any revisions and to confirm you are happy for it to go to print. After the 18 month period additional charges will apply.

14. Commercial broadcast of your wedding

This contract is for private weddings only. It explicitly does not allow for the recording of TV shows, YouTube videos or any other broadcast media being present. If this is the couples intention this must be made aware to Lee Hawley Photography prior to bookings. If the couple choose to have commercial broadcasters at their wedding a renegotiation of the fee is applicable. If this is not possible the terms of the contract have been broken and section 2 applies.
